The United Nations Development Programme (UNDP) is looking for the highly
qualified and experienced national candidates for the position of National
Policy Research Consultant in Rule of Law and Access to Justice (Special Service
Agreement contract).
Attached are the Terms of Reference.

TERMS OF REFERENCE
National Policy Research Consultant
1. Background
In the backdrop of the ongoing One UN Reform process in Vietnam and based on
UNDP?s
comparative advantage, the results identified in UNDP?s CPAP 2006-10, and an
assessment of
the Country Office?s current capacity in that area, the National Policy Research
Consultant
position in Rule of Law and Access to Justice (ROL & A2J) has been established. The
Consultant is expected to play an important role in increasing the visibility of
UNDP in the area
of legal judicial reform, by enhancing the organisation?s credibility as a lead
coordinator in the
donor community. The Consultant will contribute towards ensuring that the
results of the UNDP
country programme are achieved by strengthening UNDP?s participation in the
national policy
dialogue and enhance the policy impact of UNDP programmes and projects;
In this context, the post of National Consultant is identified to support the
Policy Advisor in ROL
& A2J in promoting UNDP?s policy advocacy and policy dialogues initiatives in
the field of legal
and judicial sector reform, through legal and policy research and analysis and
related tasks. The
Consultant will work in close collaboration with the Local Policy Support
Officer and staff of the
Governance Cluster, the operations team, programme staff in other UN Agencies and
Government officials, technical advisors and experts, multi-lateral and
bi-lateral donors and civil
society.
2. Specific functions and tasks:
2.1 Supporting the Policy Advisor in ROL & A2J in identifying trends and
developments in
legal/judicial sector reform through research and analysis on law and
legal/judicial reform:
? Responsible for proactive monitoring of Vietnamese media and other sources of
information to keep abreast of trends and developments relevant to legal and
judicial
sector reform in Viet Nam, analyzing and summarizing this information and
briefing, other
Governance Policy Advisors and colleagues in UNDP as appropriate in a timely
manner;
? Under the guidance of the Policy Advisor in ROL & A2J, drafting written
briefing notes,
policy notes etc. for internal and external distribution to keep UNDP and its
partners
abreast on developments in legal/judicial sector reform.
2.2 Supporting the Policy Advisor in ROL & A2J in building strategic
partnerships and developing
opportunities for policy advocacy and dialogue:
? Building and maintaining partnerships with counterparts in Vietnamese
institutions, including
state institutions and agencies (especially NA, MOJ, SPP and SPC), research
bodies, civil
society and other non-State organizations, law faculties and universities, bar
associations
and other professional bodes, as well as bilateral and multilateral donors;
? Advising UNDP on opportunities for policy advocacy and policy dialogue with these
institutions and supporting the strategic development of these opportunities;
2.3.Conducting research and analysis on law and legal/judicial reform, focusing
on achievement of
the following results:
? Conducting legal research and analysis as required, compiling draft and
promulgated legal
normative documents and other relevant material and producing written and oral
briefings on
Vietnamese law and regulations;
? Conducting research and analysis into legal and judicial sector reform in Viet
Nam as
required, including analysis and synthesis of strategic plans and activities of
state bodies and
organs, bilateral and multilateral donors, professional bodies, civil society
organizations and
others;
? Supporting Policy Advisor in ROL & A2J, other Governance Policy Advisors and
colleagues
in UNDP by producing and updating briefings and materials as required to support
UNDP
initiatives on technical legal/judicial reform questions;
? Identifying areas for support and interventions within the thematic/sectoral
areas assigned.
2.4 Ensuring facilitation knowledge building and management in the area of law
and legal/judicial
reform focusing on achievement of the following results:
? Compiling comprehensive documentation of relevant legal normative documents
and other
texts related to areas of legal and judicial sector reform and other areas
relevant to
governance; and assisting Local Policy Support Officer to maintain updated and
user-friendly
record-keeping and information retrieval systems in relation to this documentation;
? Performing informal translations into English or summaries in English of
Vietnamese legal
provisions, articles or other documents as requested.
3. Expected outputs:
? Sets of compiled Compiling comprehensive documentation of relevant legal
normative
documents and other texts related to areas of legal and judicial sector reform
and other
areas relevant to governance; and assisting Local Policy Support Officer to
maintain updated
and user-friendly record-keeping and information retrieval systems in relation
to this
documentation;
? Discussion papers and research reports on thematic areas under the guidance of
Policy
Advisor in ROL & A2J;
? Translation/interpretation services to the Policy Advisor in ROL & A2J and
other governance
advisors upon their request.
4. Time frame:
The duration is 8 working months with possibility for extension, subject to the
performance and
office needs.
5. Required Qualifications:
? Master Degree in Law;
? At least 5 years? legal professional experience preferably working for or with
relevant state
agencies, non-government organizations, or professional institutions engaged in
legal/judicial reform issues. Previous professional or academic engagement from
abroad is
an asset;
? Computer literate (fully competent in MS-Office based applications and
internet research);
? Fluency in English and Vietnamese.
