I think it's simple.

Gates splist the companies into two. One with the O/S the other with the 
Application layer.

The MS/OS develops an operating system under contract for MS/SOFT (whilst 
also developing an open source Linux based system to toss the attention 
from reality.)

MS/SOFT has a contract of confidentiality as the O/S is critical to it's 
business platform and that's NOT exclusive dealing.  You can contract 
someone to develop something unique for your company.

MS/SOFT only releases to the public the interfacing to it's APPLICATIONS 
not the O/S and thus tightening the market and monopoly position.

It's very hard to interface at the non existent LAYER8!!

Then what happens is MS/OS applies for a Patent on the ENTIRE O/S 
technology and voila!  The World is Fscked again!

Ain't life grand!  And someone asked me why I was dumping Australian next 
year and moving to the USA.  I just wonder.
