What tradition of open publication are you talking about? Essentially
all scientific journals require the author to assign copyright to the
journal, which vigorously enforces it. Scientific journals in electronic
form are at the forefront of restrictive electronic publishing - ask any
library.

There are a few exceptions - but those are reactions to the above,
exceptions which prove the rule.
