>An ISP of course holds email on behalf of its customers until
>delivered to its final destination. ISP suspects customer X is
>spamming, which is against the Acceptable Usage Policy.
>A staff member at ISP begins reading emails being sent by customer
>X, and determines that no, the emails being sent are not SPAM.
>Has ISP broken any laws?
>Has the staff member?
Providing the Staff and ISP do not discuss, disclose or provide any of the
information they come to view to another party, they are protected under
Part 13 of the Telecommunications Act.
That's how simple it is.
There is no need to banter on this for months or weeks. Part 13 says it all.
