I hope other Linkers will dig up definitive references for this.
AFAIK, email is not covered by the BSA. The only Internet services
that are covered and subject to the legislation are:

(*) web (HTTP)
(*) news (NNTP)

All other services and forms of TCP/IP communications are not
covered ro affected. (strange, that!)

Regarding the dismismal: if it was not clearly stated in the
employment contract that
(a) email remains the property of the company; and
(b) pr0n is not acceptable usage of company email facilities
this ex-employee would have a very good claim for damages
and being rehired.

There was a related case of such stand downs at Telstra, on
related issues involving apparently inappropirate web usage,
probably about eight months ago now.
