[Acthra_list] Circle sentencing case and comment on the Review Report

Hello all

 

Another unreported matter, again kindly sent to us by Richard Refshauge,
concerning an application in the Magistrates Court to have sentencing matter
referred to the Ngambra Circle Sentencing Court. The prosecutor objected
because the applicant had previously been an elder on a circle sentencing
panel. Magistrate Madden considered that it might breach the right to
equality under the Human Rights Act to exclude him on this basis.

Hilary and I have also written a brief comment on the 12 month Review Report
for the Canberra Times, as the Report seems to have received no media
attention, but so far it doesn't seem to have made the running (Canberra
