Witness for the Defence: Testimony on Behalf of Indonesian Crew Members
Accused of People-Smuggling

Abstract:
For the past year, barristers and lawyers for Legal Aid from three
States – Queensland, New South Wales and Victoria – have requested
‘expert advice’ in the defence of Indonesians on trial for bringing
asylum-seekers into Australia. As a consequence, I have provided a
variety of specific reports and testimony on more than twenty cases,
most of which ended in acquittal. In virtually all these cases, the
Indonesian crew members involved were themselves the victims of the
people-smugglers. Mostly poor, often illiterate and unemployed, they
were easily deceived and manipulated. Reading the case material provided
a wide perspective on the people smuggling activities in Indonesia.
This presentation will discuss a range of issues related to this work.
