[IntLawProfessors] Guinea Current Commission - administration of protocols (and their secretariats)

Hi all,

 

ELI has been asked to compare the relative merits and limitations of establishing  a Guinea Current Commission by (1) an international treaty, and (2) as a protocol to the Abidjan Convention.  This has generated a couple of interesting questions.  

 

(i)                  Do you know of any instances where a body established by a protocol (e.g., a secretariat) is administered by a different organization than the parent convention?  This could be from the international environmental context, or otherwise.  While such matters are - strictly speaking - up to the member states to decide, are there any examples where a convention is administered by one UN agency and the protocol by another UN agency or by a regional body?

 

(ii)                Do you know of any instances where a body established by a protocol has its own legal status (i.e., is not administered by any institution, including the secretariat of the parent convention)?

 

If you have any examples or comments, I would be grateful if you could respond off-line.  I will compile the responses and share them with the list.
