Just a little further. 

I think the case I was referring to was:
Hawkes & Son (London) Ltd v Paramount Film Service Ltd [1934] Ch 593.

... and it was in relation to a newsreel rather than a broadcast.  
In addition, they argued that it was not a substantial part of the song that was reproduced (being about 20 seconds of a four minute piece ("Colonel Bogey")).  The judges didn't have a bar of that argument - so to speak.
