it's not roundabout at all. it's clearly spam.
whether some or all are free or not is IRRELEVANT to the question of whether
they are spam or not. spam is an issue of consent, not content.
it was an unsolicited advertisement, so it's spam.

ps: spammers always say "my spam is not spam". they're either
consciously lying or they have deluded themselves that their spam is so
interesting/important that it can't possibly be spam. in this case, i'd
guess the latter - ignorance rather than malice.
