No, it is both. Specifically Computer Software and Films are mentioned in
the general scope of the criminal provisions..
That said, in general simply downloading a movie would not be covered by the
criminal provisions, however it could probably be argued that distributing
the downloaded copyright material could be criminal - and of course P2P
involves uploading as much as it involves downloading...
The Attorney-General's Department has a lot of copyright information on
their website at http://www.ag.gov.au/copyright
