I don't think we're disagreeing :)
Legislation of course overrules TOS.
The problem is what we are doing these days is new enough that  
legislation doesn't cover it (and what there is often bad, as the  
politicians really didn't understand what they were being lobbied for)

But I stand by my definition (until someone offers something better)  
that content piracy (ie not the high seas sort ;)) occurs when a TOS  
is breeched.
