depends. if he's talking OSI model[1] (which seems to be the case) then
it's layer 2.

the (roughly 4-layer) IP model[2] doesn't map exactly to the 7-layer OSI
model.

worse than that, i think it's counter-productive.  it's crying wolf, and
serves only to hide REAL privacy infringements (by google and others).
