Simple: the US does not recognize jurisdiction of the ICC.
The ICC, and the whole idea of "international criminal court" is the
nightmare of people who have nightmare of black U.N. helicopters
violating US sovereignty.

In fact, the US government requires countries that do joint military
exercises with US troops to exccempt them from local prosecution and
ICC jurisdiction.
