I posted something similar on the Linux-aus mailing list a short time
ago, I knew I should've CC'd it to LINK.  Anyway, my somewhat long
email goes into this in a little more detail (with useful links to
ACCC explanations and the legislation).  You can see it here:

The summary is that it's not just Section 47 of the Competition and
Consumer Act 2010 (which replaced the Trade Practices Act).  Sections
45 (anti-competitive agreements) and 46 (misuse of market power) may
also be applicable.
