This, to me, highlights another significant difference.

There's an effective monopoly in the supply of potable water, other than rainwater tanks held by the individual.

No-one sued because supply was still available, but tainted by the requirement to boil the water first.

In short, it's a crummy metaphor, but rather than diluting this further, perhaps there are more appropriate metaphors to illuminate the possible parallels elsewhere?
