One thing they don't say in this article is that the German police reviewed
the account content. The court's press release at <http://www.berlin.de/
gerichte/presse/pressemitteilungen-der-ordentlichen-gerichtsbarkeit/
2017/pressemitteilung.596076.php>
contains a link to the 48 page decision (in German).
Facebook now has a 'legacy contact' which can be set so another facebook
user can deal with your account after your death. See:
https://www.facebook.com/help/1568013990080948 It is a very useful feature
and should be widely encouraged. They refer to it in the article with the
comment that take up is low. If you use facebook - set it!!
Google also has a similar feature in its 'Inactive Account Manager'
https://support.google.com/accounts/answer/3036546
The key to a lot of this is in giving the account holder control to
designate such contacts. Many socmed (and other) services don't do this or
don't do it effectively.
I did a very thorough session at the IGF just over a year ago which
ventilated the many issues with your digital legacy in the international
context: https://www.youtube.com/watch?v=U83KCXMWwrk
Or here for the Australian version [
http://accan.org.au/accanevents/1226-accanect-2016 Session 9]
or even here for the NZ version [https://internetnz.nz/event/death-and-internet
]
In Australia we have different laws in each state, and each can apply if
you are a NSW resident that dies in Victoria for example.
The US is going for standardised approaches, the Fiduciary Access to
Digital Assets Act, Revised (2015) is being introduced and enacted across
the States:
http://www.uniformlaws.org/Act.aspx?title=Fiduciary%20Access
%20to%20Digital%20Assets%20Act,%20Revised%20(2015)
We (at ACCAN www.accan.org.au) recently proposed work to create a standard
for this in the ISO although work is yet to commence.
But of course the other aspect of this particular case is that the child
was a child...
