SPC invites applications for the position of Legal Advisor for the Deep Sea Minerals Project with the Applied Geosciences and Technology Division, located at its Suva Office in Fiji.



Applied Geoscience and Technology Division – The division, which was established when the former SOPAC was integrated with SPC in January 2011, has three technical work programmes: Ocean and Islands, Water and Sanitation, and Disaster Reduction. Its services to SPC’s members include assessments of the potential of ocean and onshore mineral resources, maritime boundary data collection, coastal protection and management, geo-hazard assessment, water, wastewater, sanitation, disaster risk management, mapping and surveying (including GIS and remote sensing), and natural resources economics. The division’s work provides guidance on scientific and technical aspects of the region’s seabed mineral resources, supports development of national policy and regulatory frameworks, and contributes to geoscientific and geotechnical understanding of the underlying causes of environmental vulnerability in the region. Its work also focuses on: developing knowledge-based adaptation strategies for coastal and near shore environments, water and sanitation, disaster risk reduction and awareness raising, and technical capacity building and capacity supplementation. The division seeks to maintain a reputation for excellence as the region’s principal provider of geoscientific services.



Deep Sea Minerals Project – The Deep Sea Minerals Project, launched in 2011 and currently contracted to run until March 2016, provides technical assistance to 15 Pacific ACP States, with a focus on supporting governments to develop and implement comprehensive policy and legislative frameworks to manage deep seabed mineral developments. Countries participating in the project are: Cook Islands, Federated States of Micronesia, Fiji, Kiribati, Marshall Islands, Nauru, Niue, Palau, Papua New Guinea, Tonga, Samoa, Solomon Islands, Timor Leste, Tuvalu and Vanuatu.  Project partners include international, private sector and civil society organisations and academic institutions.



The role – Under the direction of the Project Team Leader, the Legal Advisor will improve the legal and regulatory regimes and institutional capacities for the sustainable management of deep-sea mineral resources in the region, in accordance with international law and best practice.  The Legal Advisor will be responsible for: (i) assisting and supporting participating countries in the development, review and enactment of their national deep-sea minerals policy, legislation and regulations; (ii) providing legal advice on issues relating to deep-sea minerals exploration and exploitation, including the negotiation of contracts, and engagement with the International Seabed Authority; (iii) designing and delivering training, information materials, and other capacity-building initiatives related to deep-sea minerals, including the relevant international law framework for deep-sea mineral development and how to transpose this into national law, and the general principles of good governance and best regulatory practice; and (iv) assisting the Project Team Leader in the planning, preparation and implementation of all project activities.



The profile – An efficient and analytical Legal Adviser with a solid background in drafting and providing legal advice.  Attributes should include the ability to make sound judgements, the ability to promote equity and equality, good interpersonal skills, and the ability to work in a team.



Key Selection Criteria



1. Qualifications

Postgraduate degree in Law and/or related fields, with a specialisation in public administrative law, the law of the sea, relevant international environmental law, or minerals law.


2 Technical experience

A minimum of eight years of professional work experience, preferably in legal practice, working in government, a regional / international organisation or a law firm specialising in international law, the law of the sea, and/or the extractive industries.  Expertise and experience concerning aspects of the law pertaining to deep-sea minerals.  Expertise and experience of regulatory frameworks concerning the extractive industries.  Project and human resource management skills.  Experience in policy development, working in developing countries, and using a multi-stakeholder participatory approach. Familiarity with international and/or regional organisations.


3.Language skills

Proficiency in English, with a working knowledge of French being an advantage.


4.  Capacity building

Solid experience in designing and delivering national and regional project meetings, training and workshops.  Ability to draft and publish guidance information and materials to inform Pacific Islands about legal issues related to deep-sea minerals.  Expertise in providing supervision, guidance and training to legal interns and Pacific Island government lawyers.


5. Cultural awareness

Cultural sensitivity and demonstrated understanding of developing countries, in particular Pacific Island countries and territories, would be advantages.




Remuneration – The Legal Advisor is a Band 11 position within SPC’s 2014 salary scale, with a starting salary range of 2,719–3,399 SDR (special drawing rights) per month, which currently converts to approximately FJD 7,603–9,505 (USD 4,164–5,206; EUR 3,061–5,206). An offer of appointment for an initial contract will normally be made in the lower half of this range, with due consideration being given to experience and qualifications. Progression within the salary scale will be based on annual performance reviews. Remuneration of expatriate SPC staff members is not subject to income tax in Fiji; Fiji nationals employed by SPC in Fiji will, however, be subject to income tax.



Benefits – SPC provides subsidised housing in Suva. An establishment and relocation grant, removal expenses, airfares, home leave, medical insurance and education allowance are available for eligible employees and their recognised dependants. Employees are entitled to: 25 days annual leave and 30 days sick leave per annum, life insurance, and access to SPC’s Provident Fund (contributing 8% of salary, to which SPC adds a matching contribution).



Languages – SPC’s working languages are English and French.
