Yes, you are right, it is still opt-out .. obviously it should be opt-in.

"The majority of the participants in the trial that were interviewed 
favoured the opt-out model (62%) and 35% favoured the opt-in model and 5% 
had no opinion"  .. and ..

"Overall there was an opt-out rate of 5.1%"
