The legal position in Queensland is that uniforms are not compulsory in any
Queensland state school.

If a student is not conforming with the school uniform, though reasonably
dressed, the principal may inform the parents that the dress is
non-conforming and hold further discussions with the parents and student. If
a student is persistently not conforming with the school uniform, though
reasonably dressed, the principal may use appropriate conflict-resolution or
mediation strategies, which may involve other members of the school
community. It must also be remembered that any decision to impose a sanction
against a student is a decision Which may be reviewable under the Judicial
Review Act 1991.

The State Government is resisting calls to resolve the legal limbo over
compulsory school uniforms.

Ombudsman Fred Albietz raised the issue last year when he said state school
principals were acting unlawfully by making students wear uniforms.

Do I have to wear a school uniform?

There is no law or regulation about school uniforms. Strictly speaking,
neither the Principal nor the school council can insist you wear a school
uniform against your parents' wishes.

Schools work out their own rules about uniforms, and this is a matter that
can be resolved by discussion - there is no law about it.

Inquiry into Dress Codes and School Uniforms in Victorian Schools

The LIV notes that the Department of Education states that "[e]ach school
council decides whether the school will have a uniform, what the uniform
will be, and whether it will be compulsory to wear."1 The LIV is also
familiar with the Schools Reference Guide, including the guidance provided
regarding "student dress codes",2 and the Student Discipline Procedures
1994.3

The LIV is generally satisfied that the relevant section of the Schools
Reference Guide (s4.8) represents an appropriate guidance for student dress
codes. However, the LIV submits that the Department of Education should
develop a more formal policy to guide Victorian schools that elect to have a
student dress code on how best to develop and implement the code.

The school uniform policy must take account of fundamental rights and
principles, including those enshrined in the Charter of Human Rights and
Responsibilities 2006 (Vic) (the Human Rights Charter). The development of a
school uniform policy by the government, and the subsequent
