Yes, and no.  On their ADSL products I believe you're right and it's opt-in
(off by default).

On their mobile products (3G/4G) it is on by default. The normal way to
disable it is to verify yourself using a credit card (because apparently
people below 18 can't get access to a credit card?!). I am an O2 pre-paid
customer, and tried "opting-out" earlier in the year to see the process,
but failed miserably as it wouldn't accept either my US or Australian
credit cards as "proof".

On their WiFi products, it's on on by default, and can not be changed.
