oh, and btw, "breach of the defined Terms of Use" is *NOT* a correct use
of the term, either.
Terms of Use and EULAs often have many clauses which are unenforcable
or even unconscionable (IMO, reprehensible). they are a) indulging in
wishful thinking, b) trying to fool people that they have more rights
than they legally do, and c) trying to confuse the distinction between
copyright law and contract law, benefitting from both even though they
are contradictory.
corporations don't get to define copyright law in their licensing terms.
