And it would seem the \Federal Government is taking it's cue from the
Judiciary on this matter.

DFAT have denied that they discussed a three strikes and your out policy
at the Mexican ACTA talks- according to this article.

DFAT says we can work it out.
The Department of Foreign Affairs and Trade (DFAT) has poured cold water
on speculation Australia would adopt a "three strikes" rule, which would
see ISPs cut off subscribers that were found to have shared copyright
protected files on more than two occasions.

It would appear that the Government are listening to the people.
So I guess now we only have "The Filter" and additional (useable) ISM
(spectrum) bandwidth and we're all happy lads and lasses.... Nest pas?
