There's a long discussion of this in the judgement.
To summarise poorly, the act of "make available online" was considered to have happened when a member of a BitTorrent swarm had finally received all pieces of a file and has first flagged as a "seeder", i.e. a client with all pieces. Also, the judgement considers the entire swarm as one entity, saying that to start thinking of each piece as an individual transmission or make-available act is looking at the process at the wrong scale -- akin to looking at individual data packets.
