Ofcourse, the government could just legislate to regulate the
bit they are buying from Telstra and not have the NBNCo
run it.

This is the arrangement with AGL a monopoly non-government
controlled supplier of gas in Sydney,  if not NSW. AGL's
pricing is regulated by IPART, the same mob who regulate
Electricity Prices.
